ASSUMPTION OF RISK:
I agree that I and/or my dependents are voluntarily participating in the activities offered by ADVENTURE PARK including, but not limited to, the use of the equipment, facilities, and the premises. I acknowledge on behalf of myself and/or my dependents, all risk of personal injury, disability, sickness and potential death that may result from participation or engaging in strenuous activity, as well as any damage, loss or theft of any personal property which may incur to me and/or dependents. I understand that the ADVENTURE PARK facility has trampolines, and other equipment and that using ADVENTURE PARK facility and equipment have inherent risks, which include the risk for serious physical injury and potentially death. I also understand that ADVENTURE PARK is taking all necessary pre-cautions in terms of social distancing and cleanliness to fight potential transmittable diseases; however, this does not eliminate the chances of transmission. Further, I have explained these risks to my dependents. Despite the risks mentioned above, I freely want to participate and as such, I assume all of the risk and responsibility for the injury, sickness, death or disability that may result to myself or my dependents due to or in connection with any activities at at ADVENTURE PARK (whether undertaken by me, my dependents or other persons), entering all available Facilities and/or otherwise arising out of or in connection with my or my dependent’s presence at the ADVENTURE PARK.
UNDERTAKING OF RISK:
I above mention Parent / Guardian undertake all responsibilities / risk for my above mention child for personal injury, disability, sickness and potential death that may result from participation in ADVENTURE PARK activities With or without Eyeglasses at my own decision and neither Adventure Park nor its parent, subsidiaries, related entities, their Staff/ Management, officers, directors, will be liable for any loss or damages.
As their acting guardian, I am responsible for these children and agree to be bound by these conditions on their behalf and I will directly supervise them at all times by signing these Terms and Conditions as well as the waiver of liability.
MEDICAL RELEASE:
I am aware that it is advisable to consult a doctor or physician before undertaking any physical activity. I warrant that I and/or my dependents do not suffer from any medical condition, and/or incapacity which may impair myself and/or my dependent’s ability to use and participate in the activities and services and further, that I and/or my dependents do not suffer from any heart condition, epilepsy, allergies, skeletal conditions, spinal, history of sport injury or any other medical condition which may result in us placing ourselves in a position of risk by participating in the activities/services. I am aware that pregnant individuals are not permitted to take part in any of the activities at ADVENTURE PARK. I also agree that I am responsible for any and all medical costs, including, but not limited to ambulance, hospital, pharmacy, physiotherapy, psychological, rehabilitation.
I hereby declare my legal responsibility for myself and/or my dependent(s) and I agree to all of the above terms stated in this document, including agreeing to indemnify ADVENTURE PARK and Associated Entities* from any and all legal action, claim or litigation that may be brought by or on behalf of the dependent(s). Should any claim be made, I understand and agree that I will be responsible for all attorney’s fees and defense costs incurred by ADVENTURE PARK or Associated Entities in connection with or in defense of that claim.
*Associated Entity means any company, partnership or other entity controlled by, controlling or in common control with, Emaar Entertainment LLC or its parent. A person, company, partnership or other entity shall be deemed to control another person, company, partnership or other entity if the former person, company, partnership or other entity possesses, directly or indirectly, the power to direct, or cause the direction of, the management and policies of the other person, company partnership or other entity whether through the ownership of voting securities or partnership interests, representation on its board of directors or similar governing body, by contract or otherwise.
I hereby declare my legal responsibility of the minor(s). I also hereby agree that all responsibility of the minor is mine, once he/she leaves ADVENTURE PARK . On behalf of the minor(s) , I agree to all the above terms stated in this document and agree to indemnify ADVENTURE PARK and Associated Entities from any and all suits that may be brought by, or on behalf of the minor(s).
In general, I shall hold harmless and wholly indemnify ADVENTURE PARK and Emaar Entertainment LLC together with its Associated Entities, its/their members, employees, officials, representatives, agents landlord and successors against any and all liability, claims, demands, actions, direct, indirect, special, punitive, incidental, exemplary or consequential damages, or any damages whatsoever, including but not limited to liability, whether foreseen or not, arising out of or in any manner in connection with, my attendance at the ADVENTURE PARK and/or usage of any facilities therein in any manner whatsoever, personal injury, property damage or loss, and/or other damages to self or otherwise, howsoever occasioned.
